Unless I'm missing something, the energy boost has no downside, so no reason to ever turn it off...why not just have it on and get rid of the HUD icon?

My guess would be that, since it gives x energy at y interval rather than just modifying energy stats it was way easier for them to just make it an active module with a cooldown than a passive module. If you notice it also doesn't change your ships 'time to energy depletion' stat (can't remember the exact name) that calculates the time to depletion with all modules turned on. If they wanted to make it a passive module they would either have to make it increase your energy recharge (powercore speed module already does this) or implement a timer and actions for passive modules rather than just modifying stats.
